# The Docket

> The Docket is a weekly publication about the decisions climate change is already putting in front of Americans: whether to buy the generator, whether the flood insurance is enough, whether to stay in the city you love. It follows the people making those choices now. It treats climate anxiety as a reasonable response to real conditions. It won't tell you what to do, but it shows the tradeoffs clearly.

## Issue 33 — The Lab

Experimental content exploring innovative ways to illuminate our climate-changed world

### The Interior Log

- [smoke\_week\_notes\_0818–0822.docx](<https://anchor.is/docket/issue/33/lab/article/16880/markdown>) — By [David Kern](<https://anchor.is/docket/team/36/markdown>) · Published 2026-05-20 · Format: The Interior Log

Most school districts in wildfire-prone states adopted air quality protocols after the 2020 smoke seasons. The protocols establish action levels keyed to AQI thresholds: modified recess, indoor lunch, shelter-in-place. The last action level is shelter-in-place. There is no AQI threshold that triggers closure. Closure requires a recommendation from county health. The document below is one administrator's internal log from a week the air quality went past the protocol's last level and kept going.

### The Gap Text

- [Two Registers / Same Air](<https://anchor.is/docket/issue/33/lab/article/16881/markdown>) — By [Seth D. Carrington](<https://anchor.is/docket/team/30/markdown>) · Published 2026-05-20 · Format: The Gap Text

EPA guidance tells schools what to do at each AQI threshold during wildfire smoke. Schools do what the building, the budget, and the duct tape allow. Both tracks run here through the same six color bands, Green to Maroon. At Green they nearly touch. By Maroon the guidance is five words long and the building is running MERV 8 filters through twenty-six-year-old ductwork with six hundred kids inside.

### The Triage Margin

- [Returned to Class](<https://anchor.is/docket/issue/33/lab/article/16882/markdown>) — Published 2026-05-20

*The following triage log entries are from the student health office at Millard Fillmore Elementary during the week of May 11–15, 2026, when wildfire smoke from a fire complex 340 miles to the south held the Air Quality Index between 138 and 224. The school remained open all five days. Nurse Truesdale agreed to let us publish the log on the condition that student identifiers be reduced to age and grade, and that we print the Notes field, which she described as "the part where I write what the form doesn't have a box for." Her name is the one she chose for the record.*

### The Number

- [AQI 151](<https://anchor.is/docket/issue/33/lab/article/16883/markdown>) — Published 2026-05-20

2:14 p.m. AirNow registers 151. Orange tips to red. The district server fires an alert to 11,000 phones before any human reads the number.

### The Decision Makers

Same smoke. Same week. Six people in the same district, each facing one call. They will not coordinate. There is no mechanism for them to coordinate.

Six cards follow. Four fields per card: the person's role, the decision in front of them, the policy or budget constraining their options, and the single variable beyond their control that determines whether the decision turns out to have been right.

Regional AQI at 8 a.m.: 162. By mid-afternoon it could read 90. It could read 240. Every decision below was made before anyone knew which.

**Decision:** Cancel outdoor recess for the morning. **Constraint:** District policy triggers cancellation at AQI 150. The 8 a.m. reading was 162. No binding federal standard exists. **Beyond their control:** Whether the AQI drops below threshold by lunch, when 14% of enrolled students carry asthma diagnoses.

- **Whether to Hold or Cancel Tuesday Practice** — [Source](<https://www.sysa.org/air-quality>) — Published 2026-05-20

Tag: Soccer Coach

**Decision:** Hold or cancel Tuesday evening practice. **Constraint:** League rules require the cancellation call by 3 p.m. at AQI 151. No communication by 3 means practice proceeds as scheduled. **Beyond their control:** Three families rely on practice as their only after-school childcare arrangement.

- **Whether to Modify the Outdoor Crew Break Schedule** — [Source](<https://ehs.lbl.gov/service/wildfire-smoke-and-air-quality/cal-osha-requirements-for-outdoor-workers/>) — Published 2026-05-20

Tag: Work Supervisor

**Decision:** Add extra rest breaks for outdoor crews. **Constraint:** OSHA's April 2026 National Emphasis Program now directs inspections to 55 high-risk industries. No federal rule mandates a specific smoke break frequency or duration. **Beyond their control:** The pace the general contractor's schedule requires.

- **Whether to Leave Work for Early Pickup** — [Source](<https://www.dol.gov/agencies/whd/fact-sheets/28-fmla>) — Published 2026-05-20

Tag: Asthmatic's Parent

**Decision:** Leave work mid-shift to pick up the child. **Constraint:** Employer's leave policy. FMLA requires a "serious health condition." A smoke-triggered asthma flare that hasn't reached hospitalization typically falls below that legal threshold. **Beyond their control:** The school's ventilation system and its filter rating.

- **Whether to Run Afternoon Routes With Windows Closed** — [Source](<https://www.nea.org/advocating-for-change/new-from-nea/air-quality-school-buses-matters-too>) — Published 2026-05-20

Tag: Bus Dispatcher

**Decision:** Close windows on all afternoon routes. **Constraint:** Fleet age. Functioning AC comes standard on newer buses, absent on most older vehicles. Sealed windows without mechanical ventilation trap CO2 and heat inside the cabin. **Beyond their control:** Route duration in smoke-week traffic congestion.

- **Whether to Swap in MERV-13 Filters Mid-Event** — [Source](<https://cleanair.camfil.us/2025/08/26/us-green-building-council-and-ashrae-fact-sheet-tips-for-smarter-hvac-filtration-and-cleaner-air-in-schools/>) — Published 2026-05-20

Tag: Building Custodian

**Decision:** Pull current filters and install MERV-13 replacements mid-event. **Constraint:** Maintenance budget and system compatibility. Pre-2000 HVAC units with 1-inch filter slots cannot handle MERV 13. Where they fit, MERV-13 filters capture roughly 69% of wildfire-size particles. **Beyond their control:** How many days the smoke persists.
