# The Hysteresis

> The Hysteresis exists to give a small cross-functional team — strategy, investment, and procurement — a shared weekly instrument for reading the battery supply chain earlier than consensus. Success means the team consistently identifies inflection points in cell pricing, supplier health, and policy enforcement weeks or months before they surface in earnings calls, annual surveys, or trade press. The commercial mechanism is internal-first: the publication proves itself as a decision tool inside the organization, then extends to paid subscribers and a practitioner community as upside. Revenue follows utility — if the team makes better-timed procurement calls and competitive assessments because of what they read here, the publication earned its place.

## Issue 10 — Defense

Drone, UAV, UUV, and 6T battery intelligence

### Two Tests, Two Clocks

- [Two Tests, 92 Days Apart, and Neither Satisfies the Other](<https://anchor.is/the-hysteresis/issue/10/defense/article/35150/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-08-14

Defense battery procurement faces two statutory tests in sequence; passing one does not satisfy the other. [FY2024 NDAA §154](https://www.congress.gov/118/plaws/publ31/PLAW-118publ31.htm) bans batteries produced by six named Chinese entities, effective October 1, 2027. "Produced by" means the entity assembled the product or provided a majority of its components. Ninety-two days later, 10 U.S.C. §4865 (FY2026 NDAA §842) applies to new programs: non-FEOC final assembly, more than 95% of functional cell component costs from non-FEOC sources, and no FEOC-licensed technology.

### The Mandate Gap

- [The Mandate Gap — Local Proof Before Federal Standard](<https://anchor.is/the-hysteresis/issue/10/defense/article/35151/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-08-14 · Format: The Mandate Gap

DDP's July 23 supply chain framework is the first DoD program to attach dates to battery component sourcing, and its binding gate lands five months before the January 2028 §4865 deadline. DFARS Case 2024-D011, which would set the government-wide test, has now passed a congressional deadline and three projected NPRM dates without producing clause language. Compliance architecture is forming at the program level because the federal mechanism does not exist. If the eventual DFARS rule reads the statutes differently, the evidence packages built against DDP's staircase get re-cut.

### The Demand Problem

- [200,000 Drones Without a Cell Demand Forecast](<https://anchor.is/the-hysteresis/issue/10/defense/article/35152/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-08-14 · Format: The Demand Problem

DoD's Drone Dominance Program has published the largest Group 1 UAS procurement signal in recent history: 30,000 systems purchased, 200,000 planned. DIBC's BES-26-01 solicitation targets 3 GWh of domestic cell capacity. A cell manufacturer evaluating a defense-grade cylindrical line has to convert those numbers into forecastable MWh under a stable configuration, and that conversion requires watt-hours per platform, named cell suppliers, configuration persistence across delivery tranches, and committed government offtake. None of those fields appear in public DDP or DIBC documents.

### Compliance Dashboard

Two compliance regimes — the §154 named-company ban and §4865's FEOC cost threshold — are approaching the same supply base on overlapping timelines, and the implementing rules for both remain unpublished. DFARS Case 2024-D011 is 19 months behind its original schedule. The §154 ban takes effect in 413 days; §4865's first deadline for new programs arrives 92 days after that.

DDP's July 23 supply chain framework is the material development this cycle. It operationalizes battery sourcing restrictions as competition conditions now, months ahead of statutory deadlines. The domestic qualified-supplier pipeline behind those mandates remains thin: zero sources on the 6T QPL, DIBC's cylindrical cell solicitation closed without a public award, and no supplier holds a publicly documented §4865-complete cost file for any defense platform.

CATL, BYD, EVE, Gotion, Envision, Hithium barred from DoD procurement starting October 1, 2027. No DFARS clause or enforcement mechanism published. DDP's July 23 framework already applies the prohibition as a live competition condition, 14 months ahead of the statutory date.

New programs: January 2028 (505 days). Standard batteries: January 2029. Existing programs: January 2031. The 95% non-FEOC functional-component cost threshold remains the operative test. No supplier has a publicly documented §4865-complete cost file tied to a defense platform.

The implementing rule for both §154 and §4865 has produced no NPRM, interim rule, or class deviation. The June 16 statutory checkpoint and July 2026 NPRM target both passed without publication. Federal Register searches on August 14 returned zero documents.

July 23 Version 2 framework covers $1.1B for 200,000+ Group 1 sUAS across four phases. Phase II (August 2026) bars §154-listed battery producers. Phase IV (August 2027) requires §842-compliant cells, ahead of §4865's January 2028 statutory date. Gauntlet II results pending.

Two SBIR Phase III orders totaling $36.8M fund pouch-cell pilot production through April 2028. Procurement-funded LRIP, stronger than R&D but short of program-of-record adoption. Neither award discloses cell quantities, MWh output, or §4865 compliance status. Unchanged since August 8.

SEC filing describes a proposed 3 GWh/year Morrisville, NC facility with $300–330M investment and $100M DOE grant, targeting 2028 operations. Samsung's August 11 New Carlisle acquisition shifts its primary U.S. focus to ESS. Morrisville remains the only Samsung-adjacent site with defense-market language. No DoD contract or qualification milestone.
