# The Hysteresis

> The Hysteresis exists to give a small cross-functional team — strategy, investment, and procurement — a shared weekly instrument for reading the battery supply chain earlier than consensus. Success means the team consistently identifies inflection points in cell pricing, supplier health, and policy enforcement weeks or months before they surface in earnings calls, annual surveys, or trade press. The commercial mechanism is internal-first: the publication proves itself as a decision tool inside the organization, then extends to paid subscribers and a practitioner community as upside. Revenue follows utility — if the team makes better-timed procurement calls and competitive assessments because of what they read here, the publication earned its place.

## Issue 7 — Defense

Drone, UAV, UUV, and 6T battery intelligence

### EO Signal

- [The 4872 EO skips batteries but sets the waiver documentation standard](<https://anchor.is/the-hysteresis/issue/7/defense/article/33051/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-07-24

The [July 20 executive order](https://www.whitehouse.gov/presidential-actions/2026/07/securing-americas-defense-supply-chains-and-ensuring-domestic-acquisition-of-critical-materials/) tightens waiver discipline under 10 U.S.C. 4872: specialty metals, critical minerals, defense-critical materials. Not batteries. Section 4865 appears nowhere in the order's text, [fact sheet](https://www.whitehouse.gov/fact-sheets/2026/07/fact-sheet-president-donald-j-trump-secures-americas-defense-supply-chains-and-ensures-domestic-acquisition-of-critical-materials/), or definitions. No battery, cell, FEOC, or lithium-ion language is present.

### Waiver Architecture

- [The Mandate Gap — What the Waiver Will Ask For](<https://anchor.is/the-hysteresis/issue/7/defense/article/33052/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-07-24 · Format: The Mandate Gap

Section 4865 still has no public DFARS clause or waiver template eighteen months before the January 2028 deadline. Two adjacent regimes published waiver requirements in June and July: Section 805's intake site went live June 30, and the July 20 executive order imposed mitigation-plan demands on 4872 specialty-metal waivers. Both treat nonavailability as a condition to be proven, not asserted. Map their procedural demands onto batteries and the requirement becomes component-level cost-origin documentation across eight functional-cell-component categories, each traced to FEOC or non-FEOC origin. No public supplier has demonstrated the ability to produce that documentation.

### Proof Ladder

- [Four Defense Battery Suppliers Against the Section 4865 Proof Ladder](<https://anchor.is/the-hysteresis/issue/7/defense/article/33053/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-07-24 · Format: Proof Ladder

Four companies show public evidence of positioning for the Section 4865 defense battery market: Packet Digital, Forge Nano/Samsung SDI, EnerSys/Bren-Tronics, and Ultralife. We mapped each against four compliance dimensions and labeled every claim by source tier. Cost-origin proof is blank across all four. QPL-32565 lists zero qualified products from any manufacturer. The qualification infrastructure and the supplier base are developing on independent timelines, and neither is close to done. Eighteen months from the January 2028 new-program deadline, the ladder has rungs but no top.

### Compliance Dashboard

Three compliance regimes now converge on defense battery supply chains from different directions and at different speeds. Implementation is sharply uneven. Section 805's 1260H entity ban went live June 30 with a functioning waiver portal. The July 20 executive order is constructing mitigation-plan gates around 4872 covered-materials waivers effective January 2027. Both regimes are operationally legible.

Section 4865, the battery-specific statute, is not. Three hard deadlines are approaching. The DFARS implementation deadline has already passed. No public clause, waiver template, or compliance repository has surfaced in checked routes. The widening gap between statutory mandate and visible implementation machinery is the signal this dashboard exists to track.

FEOC battery restrictions hit new acquisitions January 1, 2028. Standard batteries January 1, 2029. Existing programs January 30, 2031. The 95% non-FEOC cost-origin threshold applies to all three tranches. Statutory 180-day DFARS revision deadline passed June 16. No implementing clause found in checked public routes as of July 17.

Tag: Entity Ban

DoD launched a public Section 805 compliance website June 30, banning direct procurement from 1260H-listed Chinese military companies. Indirect supply-chain ban follows June 30, 2027. Waiver intake requires compelling justification, market analysis, and phased removal milestones. The only live public waiver machinery in DoD right now.

Tag: Executive Order

Executive order signed July 20 targets 10 U.S.C. 4872 covered materials. Not batteries directly, but adjacent. From January 1, 2027, waivers require formal mitigation plans: identification of noncompliant sources, documented qualification efforts, strict removal timelines. Indentured BOM tracing to raw-material origin due within 180 days. Read this as a signal for where Section 4865 waiver architecture will land.

Exposed fields: platform name, manufacturer, certification status. No battery supplier, cell chemistry, cost-origin, or FEOC compliance fields visible. Platform certification is not component-level compliance.

MIL-PRF-32565 active, data current July 23. Next review August 2027. QPL-32565 active but lists no established products or sources in checked public record. Army SBIR topic A254-P050 closed May 2026 for Phase I Li-ion 6T thermal-runaway work. Awards to Farad Power, Nanotech Energy, and CAMX Power are Phase I R&D, not production commitment.

Federal Register API queries for "10 USC 4865" and "section 4865 advanced batteries" filtered to Defense Department return zero results. Acquisition.gov DFARS search surfaces no advanced-battery clause. The statutory implementation deadline passed five weeks ago. Bounded finding: no visible public artifact in checked routes. Not proof of internal inaction.

Section 805 has a live portal with forms, email intake, and structured justification requirements. The July 20 EO builds mitigation-plan gates for 4872 waivers starting January 2027. Section 4865 waiver authority exists in statute but has no public template, FAQ, or operational form in any checked route. The Section 836 compliance repository is due January 1, 2027.
