# The Hysteresis

> The Hysteresis exists to give a small cross-functional team — strategy, investment, and procurement — a shared weekly instrument for reading the battery supply chain earlier than consensus. Success means the team consistently identifies inflection points in cell pricing, supplier health, and policy enforcement weeks or months before they surface in earnings calls, annual surveys, or trade press. The commercial mechanism is internal-first: the publication proves itself as a decision tool inside the organization, then extends to paid subscribers and a practitioner community as upside. Revenue follows utility — if the team makes better-timed procurement calls and competitive assessments because of what they read here, the publication earned its place.

## Issue 8 — Defense

Drone, UAV, UUV, and 6T battery intelligence

### Solicitation Snapshot

- [DIBC's Cylindrical Cell RPP Asks Less Than §4865 Requires](<https://anchor.is/the-hysteresis/issue/8/defense/article/33751/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-07-31

[RPP BES-26-01](https://www.dibconsortium.org/wp-content/uploads/2026/06/P07-DIBC-BES-26-01_Batteries-RPP.pdf), issued by the Defense Industrial Base Consortium on June 22, puts the first public numbers on domestic 18650/21700 production: 50 MWh annually within two years of award, 3 GWh as the objective. Before treating an award as a compliance signal, read the supply-chain terms against the statute.

### The Mandate Gap

- [The Mandate Gap — 427 Days to a Battery Prohibition With No Rule Behind It](<https://anchor.is/the-hysteresis/issue/8/defense/article/33752/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-07-31 · Format: The Mandate Gap

The rulemaking object exists. It is DFARS Case 2024-D011, touching Parts 212, 240 and 252, and it carries a second battery prohibition nobody has been tracking: six named Chinese manufacturers, no chemistry limit, no dollar threshold, binding 92 days ahead of the §4865 cost test. The July 2026 proposed-rule milestone passed with nothing published. Four comparable DFARS source-restriction cases ran a median 312 days from proposal to final rule. DoD also holds an instrument that drops clause text into solicitations without a comment period at all.

### Missing Market Signal

- [Authority, Not Obligation: The Defense Battery Demand Signal Has No Floor](<https://anchor.is/the-hysteresis/issue/8/defense/article/33753/markdown>) — By [Ronan Adike](<https://anchor.is/the-hysteresis/team/74/markdown>) · Published 2026-07-31 · Format: Missing Market Signal

The Defense Industrial Base Consortium wants 3 GWh of domestic cylindrical-cell capacity stood up inside two years. It also states, in writing, that no offtake is guaranteed. Its threshold cycle life is 300 cycles, which makes the commercial fallback largely notional.

### Proof Ladder

Seven signals tracked. One finding holds across all of them: no public supplier has demonstrated Section 4865 compliance. The DFARS rulemaking that would give contracting officers an evaluation procedure missed its July NPRM window. The DIBC solicitation that would seed domestic cylindrical capacity closed submissions with no award. The QPL that would qualify a lithium 6T for Army procurement lists zero products.

Activity is real. Packet Digital holds $36.8M in Navy LRIP-stage awards. Forge Nano and Samsung SDI filed SEC disclosures for a 3 GWh North Carolina facility. DCMA says it accelerated Blue List onboarding. But the proof gap is uniform: the Section 4865 cost-origin representation, the FEOC technology-license determination, and the waiver architecture that would bridge mandate to supply reality are publicly absent across every line. Compliance clocks run toward January 2028. The proof stack does not.

Case 2024-D011 (RIN 0750-AM08) was slated for a July 2026 NPRM covering both the FY2024 named-manufacturer restriction and Section 4865's cost-origin test. Nothing appeared in the Federal Register through July 31. Without it, contracting officers lack any DFARS procedure for evaluating battery compliance claims.

RPP BES-26-01 closed Phase I submissions July 17 for domestic 18650/21700 cylindrical production (50 MWh threshold, 3 GWh objective). No award through month-end. Phase II hinges on FY2027 appropriations. Worth flagging: the solicitation's 95% electrode-active-material metric diverges from Section 4865's broader functional-component-cost test.

Two Navy orders totaling $36.8M fund pilot production and LRIP-stage pouch-cell manufacturing under SBIR Phase III and APFIT authority, with completion dates running through April 2028. This is the furthest-advanced publicly documented domestic defense cell program. Neither award discloses annual output, Section 4865 cost-origin data, or program-of-record adoption.

- **Forge Nano Samsung SDI File SEC Disclosure** — [Source](<https://www.sec.gov/Archives/edgar/data/2028516/000110465926077835/tm264900d10_ex99-1.htm>) — Published 2026-07-31

SEC-filed exhibit confirms a 3 GWh/year cylindrical-cell facility in Morrisville, NC: $300–330M capex, $100M DOE grant, 2028 SOP target. Samsung SDI signed a conditional procurement agreement. No DoD contract, QPL milestone, or Section 4865 proof package accompanies the filing. Editorial assessment: two to three conversion gates from compliant defense supply.

DCMA's public endpoint shows 71 UAV records as of July 31, unchanged from July 24, despite DCMA reporting accelerated onboarding on July 27. The public schema still exposes no battery-supplier, cell-origin, or Section 4865 compliance fields. Platform certification and battery-origin compliance remain parallel tracks that do not substitute for each other.

- **QPL 32565 Remains Empty: Zero Qualified Products** — [Source](<https://quicksearch.dla.mil/qsDocDetails.aspx?ident_number=282117>) — Published 2026-07-31

Tag: 6T Qualification

DLA Quick Search confirms no products or sources under MIL-PRF-32565. Stryten Energy independently corroborates: no vendor has demonstrated full compliance. Active SBIR Phase II awards (Tyfast, Farad Power) indicate development work, but development milestones and QPL listing are different gates. Zero listed products means zero compliant production contract pathways.

Tag: Waiver Architecture

The July 20 EO mandates documented mitigation plans for Section 4872 covered-material waivers starting January 2027. It does not touch Section 4865's battery-specific waiver procedure. Adjacent waiver regimes are getting harder on both flanks while the battery waiver channel still has no public template, form, or program-level disclosure.
