Food and beverage processing. Metal finishing. Battery component manufacturing. Specialty chemicals. All four generate process wastewater subject to effluent guideline categories under 40 CFR Subchapter N, and all four require a POTW that can document discharge compatibility before the prospect's capital commitment window closes. These sectors represent the bulk of reshoring and greenfield projects where wastewater discharge functions as a first-cut screening dimension, not a downstream detail.
The city archetype positioned to compete: a legacy industrial city of 60,000–120,000 whose POTW was designed for manufacturers that have since closed or relocated. The treatment plant was sized for 8 or 12 MGD. Current average daily flow runs 4 or 6 MGD. That headroom is documented in monthly operating reports. It represents capacity that most growth-market POTWs in the Sun Belt cannot match because their systems are already running near design limits from residential expansion.
A city with a 10 MGD design-flow POTW running at 55% capacity, two former metal-stamping sites within sewer-service range, and an approved pretreatment program already on the books holds a structural advantage on this screening dimension. The advantage almost never makes it into the RFI response as a number.
The Question
"Can your wastewater system accept this process discharge without creating permit, pretreatment, surcharge, or upgrade risk?"
Phrasing varies by sector and evaluator. The underlying question does not: will your system take what we produce, and what will it cost us in time, money, and compliance risk to get there?
The Typical Answer
"Our wastewater treatment plant has significant available capacity and can accommodate industrial users. We have an experienced public works team that works closely with new businesses to ensure a smooth permitting process. Several of our existing industrial tenants discharge process wastewater without issue. We'd be happy to connect you with our utility director to discuss your specific needs."
Every sentence is true. None of it survives comparison with a competing city that submitted numbers.
Why It Fails
The evaluator reading this answer is pricing four risks: permit delay that pushes the project timeline past the capital commitment window; pretreatment requirements that add unbudgeted capital cost; surcharges that change the operating cost model; and POTW upgrade obligations that create contingent liability.
Public RFI templates confirm this. The California GO-Biz site selection form asks for wastewater gallons per day, suspended solids in lbs/day, and BOD in lbs/day. LA County Sanitation Districts add pH, COD, peak flow, and chemical analyses tied to facility raw materials. Virginia's VPDES application requires BOD5, TSS, oil and grease, COD, ammonia, pH, temperature, and flow. These forms exist because evaluators need quantified, comparable data across competing sites. The typical answer provides none. A city that submits a one-page discharge compatibility summary with numbers passes. A city that offers to schedule a call gets screened out, even if it has more capacity than every other community on the list.
The Passing Answer — Nine Data Elements
Each sourced from a specific office, presented in a format that allows side-by-side comparison across competing communities.
Daily flow capacity. Document the POTW's design flow in MGD, current average daily flow, and available hydraulic capacity. Source: the plant's most recent monthly operating report or annual report filed with the state. Present the prospect's estimated daily process wastewater flow against the available headroom. Flag whether the prospect's flow approaches 25,000 gallons per day or 5% of the POTW's average dry-weather hydraulic or organic capacity. Either threshold can trigger Significant Industrial User classification under 40 CFR 403.3, independent of categorical status.
BOD and TSS headroom. Present both concentration (mg/L) and mass loading (lbs/day) for current plant influent versus design capacity. The GO-Biz form asks in pounds per day. POTW operating data will be in mg/L and flow. Convert both to the same basis. If the prospect's discharge adds 800 lbs/day of BOD to a plant with 3,000 lbs/day of unused organic capacity, state it that way, with the numbers.
Local limits. Compile the POTW's current numeric local limits for pH, temperature, BOD, TSS, oil and grease, ammonia, and metals. At minimum: cadmium, chromium, copper, lead, mercury, nickel, zinc. Source: the POTW's sewer use ordinance or published pretreatment program documents. Specify whether limits are concentration-based or include mass limits, whether metals are reported as total or dissolved, and the averaging period (instantaneous, daily average, or monthly average).
Local limits vary by orders of magnitude across municipalities. They are derived from each POTW's NPDES permit, receiving water quality, and sludge disposal constraints. Illustrative range from published municipal ordinances reviewed July 2026:

The prospect needs your limits, not a national average.
Categorical or SIU status. Determine whether the prospect's process falls under a categorical pretreatment standard in 40 CFR Subchapter N. Food processing prospects may implicate Parts 405–409 and 432. Metal finishing and fabricated metals: Parts 413, 433, 438, 464–471. Battery manufacturing: Part 461. Specialty chemicals: Parts 414, 415, 439, and others depending on process chemistry. Identify the specific Part. If the prospect's process wastewater exceeds 25,000 gpd or 5% of POTW capacity, it qualifies as an SIU regardless of categorical status under 40 CFR 403.3. Present this determination explicitly. A categorical discharge faces federal pretreatment standards that apply independent of local limits. SIU status triggers individual permit or control mechanism requirements under 40 CFR 403.8.
Pretreatment program status. State whether the POTW has an approved pretreatment program. POTWs with design flow above 5 MGD that receive industrial discharge subject to pretreatment standards are required to have one under 40 CFR 403.8. For cities whose POTW falls below 5 MGD and lacks an approved program: this does not disqualify the city, but it changes the path. The state environmental agency or EPA regional office becomes the control authority for categorical or SIU determinations. Name that agency and its contact in the response. Pocatello's pretreatment program provides a useful model: federally regulated discharges apply 90 days prior, locally regulated flows above 25,000 gpd apply 90 days prior, flows below 25,000 gpd apply 30 days prior. If your POTW is sub-5 MGD, present the state-level review path with the same specificity.
Review timeline. Get a written commitment from the POTW superintendent on the expected timeline for initial discharge review, SIU or categorical determination, and permit issuance. Published POTW application procedures provide reference points:

Present the timeline as a named sequence of steps with durations, not a single number.
Surcharge exposure. Document the POTW's high-strength surcharge schedule: the domestic-strength baseline by parameter, the per-pound rate above baseline, and any additional industrial permit fees, sampling fees, or capacity charges. Domestic-strength baselines vary by utility.

Representative municipal sewer use ordinances reviewed July 2026 use 250 mg/L for both BOD and TSS as domestic-strength baselines. Present the formula so the prospect can model annual operating cost.
Upgrade responsibility. State explicitly who pays for what. Pretreatment equipment on the prospect's side, monitoring infrastructure, sampling access points, any POTW-side upgrades triggered by the new discharge, connection fees, capacity charges. If the city is willing to share upgrade costs as part of an incentive package, note the authority and approval path required.
A city can pass first-cut screening without a completed discharge determination. What it cannot do is leave discharge compatibility unaddressed. Present the POTW review path as a bounded next step: name the review process, the trigger thresholds, the data the prospect must provide, the responsible party at the POTW, and the committed timeline for completion. Site selectors can work with a defined path and a named contact. They cannot work with "we'd be happy to connect you."
The Tier-3 Translation
The structural advantage is excess POTW capacity, and it is quantifiable. A legacy industrial city whose treatment plant was designed for a manufacturing base that has since contracted by 40% holds hydraulic and organic loading headroom that a fast-growing metro's system cannot offer. Converting this from anecdote to screening asset requires one document: a capacity summary signed by the POTW superintendent showing design flow, current average daily flow, available hydraulic capacity in MGD, available organic loading capacity in lbs/day BOD, and a statement of willingness to accept industrial discharge subject to pretreatment review. Pair it with the local limits table and the surcharge schedule. Three documents. Most competing communities leave this to a phone call that never gets scheduled before the shortlist is set.
